There are two ways for a patent holder to protect his interests and rights should any infringement occur:

(1)   Submit to the patent administrative authority for an investigation and prosecution. (If the infringer is located in Shanghai, or the infringement occurred in Shanghai, the applicant can submit to the Shanghai Intellectual Property Rights Office).

(2)   Institute a proceeding at court.
